Terms and Conditions of Use

• 1. Acceptance of These Terms

  This website — retirementhomesstcatharines.ca (the “Site”) — is part of a network of Canadian city‑focused senior housing and service directories powered by SeniorCareAccess.com (the “Platform”).

  The Site, the Platform, and all related content are owned and operated by Lifestyle 55+ Network Inc., an Ontario corporation (“Lifestyle 55+,” “we,” “us,” or “our”).

  By accessing, browsing, or using the Site, you (“you” or the “User”) acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions of Use (“Terms”).

  If you do not accept these Terms, do not use the Site.

• 2. Definitions

  User – any individual or organization that visits or interacts with the free materials on the Site.

  Advertiser – a residence, service provider, or other entity that pays to promote goods or services on the Site.

  Content – all text, data, software, designs, graphics, photographs, video, audio, and other information or material made available on the Site.

  Lifestyle 55+ Network Intellectual Property – the Site, the Platform, all underlying code and databases, and any materials created by or for Lifestyle 55+.

• 3. Changes to the Site or Terms

  We may amend the Site, the Content, or these Terms at any time without notice. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

• 4. Ownership & Intellectual Property

  All Content and the Lifestyle 55+ Network Intellectual Property are protected by Canadian and international copyright, trademark, and other intellectual‑property laws. Except as expressly stated in these Terms, no licence or right is granted to you.

• 5. Limited Licence to Users

  We grant you a personal, revocable, non‑exclusive, non‑transferable, and limited licence to access the Site and view its Content for non‑commercial, informational purposes only. You may download or print a reasonable number of pages for personal use, provided you keep all copyright and proprietary notices intact. Any other use—including copying, modifying, distributing, selling, or creating derivative works—requires prior written consent from Lifestyle 55+.

• 6. Prohibited Conduct

  You agree not to:

  • use the Site or Content for any unlawful, fraudulent, or commercial purpose;
  • scrape, harvest, or create databases of Site Content without written permission;
  • upload or transmit any material that infringes another’s intellectual‑property or privacy rights, or that is defamatory, obscene, hateful, or otherwise objectionable;

  • impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• 7. Advertisers

  Engagements, payments, guarantees, or representations associated with Advertisers are solely between you and the Advertiser. Lifestyle 55+ is not responsible for any loss or damage arising from dealings with Advertisers or reliance on their claims.

• 8. Links to Third‑Party Sites

  The Site may link to external websites or resources. We do not control, endorse, or assume responsibility for third‑party content. Your use of such sites is at your own risk.

• 9. Professional‑Advice Disclaimer

  All information on the Site and the Platform is provided for general informational purposes only and does not constitute medical, legal, social work, financial, real‑estate, or other professional advice. You should not act or refrain from acting on the basis of any content without seeking appropriate professional counsel. Reliance on any information provided by Lifestyle 55+, its employees, contributors, or Advertisers is solely at your own risk.

• 11. Limitation of Liability

  To the fullest extent permitted by law, Lifestyle 55+, its directors, officers, employees, agents, and affiliates will not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use—or inability to use—the Site, even if we have been advised of the possibility of such damages.

• 12. Indemnity

  You agree to defend, indemnify, and hold harmless Lifestyle 55+ and its affiliates, directors, officers, and employees from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your:

  • breach of these Terms;
  • misuse of the Site or Content;
  • violation of any law or third‑party right; or
  • dealings with any Advertiser or other third party.
• 13. User Submissions & Contributor Content Standards

  If you submit or upload any content (including listings, reviews, articles, images, or links) you agree that the material will not:

  • violate any copyright, trademark, privacy, or other proprietary right;
  • contain false, misleading, or deceptive statements;
  • be defamatory, libellous, hateful, harassing, or threatening;
  • depict discrimination or abuse based on race, gender, religion, nationality, disability, sexual orientation, or age;
  • contain pornography, sexually explicit material, or graphic violence;
  • promote illegal activity or provide instructions for committing unlawful acts;

  include viruses, malware, or other code intended to disrupt or damage software, hardware, or data.

  We reserve the right (but have no obligation) to review, edit, or remove any submission that violates these standards or is otherwise objectionable, and to suspend or terminate your access without notice.

  Licence to Lifestyle 55+

  By submitting content, you grant Lifestyle 55+ a worldwide, royalty‑free, perpetual, irrevocable, non‑exclusive licence to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such content in any media in connection with the Site and the Platform. You represent that you have all necessary rights to grant this licence.

• 14. Cookies & Tracking Technologies

  We use cookies and similar technologies to operate and improve the Site, as described in our Privacy Policy. You may disable cookies in your browser, but some Site features may not function.

• 15. Termination

  We may suspend or terminate your access to the Site at any time without notice if we believe you have breached these Terms or engaged in unlawful behaviour. Sections 4–7, 9–13, 16, and 17 survive termination.

• 16. Governing Law & Jurisdiction

  These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑law principles. Any dispute arising under these Terms shall be resolved exclusively in the courts of Ontario, Canada.
